1. Acceptance of Terms

Welcome to Lena. These Terms and Conditions ("Terms") govern your access to and use of the Lena platform, including our website at lena-official.com and mobile application (collectively, the "Platform"), operated by Lena ("we," "our," or "us").

By accessing or using the Platform, creating an account, or listing a business, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform.

2. Eligibility

You must be at least 18 years of age to use Lena.

You must have the legal authority to enter into a binding contract.

By using Lena, you represent and warrant that you meet these requirements.

3. Platform Description

Lena is a business directory platform designed to connect Middle Eastern businesses with customers across the United States. The Platform allows business owners to create profiles, list their services, and reach customers actively searching for Middle Eastern businesses.

4. Account Registration

4.1 Creating an Account

You must provide accurate, current, and complete information during registration.

You are responsible for maintaining the confidentiality of your account credentials.

You must notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that contain false information.

4.2 Business Listings

Business information submitted must be accurate and up to date.

You must have the right to use any content, images, or trademarks you upload.

We reserve the right to remove listings that violate these Terms or our content policies.

5. Subscription and Payment

5.1 Free Trial

New users are entitled to a 14-day free trial upon registration. A valid credit card is required to activate the free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid plan.

5.2 Paid Subscriptions

Paid plans are billed on a recurring basis (monthly or annually, as selected).

All fees are stated in U.S. dollars and are non-refundable except as required by law.

We reserve the right to change pricing with 30 days written notice.

Failure to pay may result in suspension or termination of your account.

5.3 Cancellation

You may cancel your subscription at any time through your account settings or by contacting support@lena-official.com. Cancellation takes effect at the end of the current billing cycle. No partial refunds are provided for unused periods.

6. Acceptable Use

You agree not to use the Platform to:

Submit false, misleading, or fraudulent business information.

Post content that is defamatory, offensive, discriminatory, or illegal.

Infringe upon the intellectual property rights of others.

Transmit spam, unsolicited messages, or malicious code.

Attempt to gain unauthorized access to the Platform or other users' accounts.

Scrape, copy, or redistribute Platform content without our written permission.

Use the Platform for any purpose that violates applicable laws or regulations.

7. Intellectual Property

All content on the Platform, including but not limited to logos, design, text, graphics, and software, is the property of Lena or its licensors and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for its intended purpose.

By submitting content to Lena (such as business photos or descriptions), you grant us a non-exclusive, royalty-free, worldwide license to display and distribute that content on the Platform.

8. SMS Communications

By providing your phone number, you consent to receive SMS messages from Lena related to your account, transactions, and promotional offers. You may opt out at any time by replying STOP to any message. Message and data rates may apply. Opting out of promotional SMS will not affect transactional messages related to your account.

9. Third-Party Services

The Platform may integrate with or link to third-party services (such as payment processors and mapping services). We are not responsible for the content, privacy practices, or terms of third-party services. Your use of such services is at your own risk and governed by their respective terms.

10. Disclaimers

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO WARRANTY REGARDING THE ACCURACY OR COMPLETENESS OF ANY CONTENT ON THE PLATFORM.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LENA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to defend, indemnify, and hold harmless Lena, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the Platform, your violation of these Terms, or your infringement of any third-party rights.

13. Termination

We reserve the right to suspend or terminate your access to the Platform at any time, with or without cause or notice, including for violation of these Terms. Upon termination, your right to use the Platform will immediately cease. Provisions that by their nature should survive termination will remain in effect.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Lena operates, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration or in the applicable courts of competent jurisdiction.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Platform and updating the effective date. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.
